This website is operated by Liza Clements Photographic. Throughout the site, the terms “we”, “us” and “our” refer to Liza Clements Photographic. Liza Clements Photographic provides this website available for your use, conditional upon you accepting all of the terms, conditions, policies and notices stated here. By using this website, you approve that you have read, understood, and agree to be bound by these Terms.
By visiting our site and / or purchasing products from us, you engage in our “Service” and agree to be bound by the terms and conditions following (“Terms of Service”, “Terms”). These Terms of Service apply to all users of the site without limitation. We reserve the right to update or change any part of these Terms of Service. You are responsible for checking these terms for updates and changes that will be posted on the site. If you do not agree to any of these terms or future updates and changes to the Terms, do not use or access this website and it’s services.

To use our website and/or receive our services and products you must be the legal age of majority in your jurisdiction, and possess legal authority, right and freedom to enter into these Terms as a binding agreement. You are not permitted to use this website and/or receive services and products if doing so is prohibited in your country or under any law or regulation applicable to you.
When purchasing an item, you agree that you are responsible for reading the full item listing before making a commitment to purchase. You also agree that you are entering into a legally binding contract to purchase the item when you complete the check-out payment process or make payment of any invoice issued by Liza Clements Photographic.

The prices we charge for our products and services are listed on the website. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.
We may, without prior notice, change the products and services; stop providing the products and services or any features of the products and services we offer; or create limits for the products and services. We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time.
SECTION 3 - PRODUCTS
Products available to purchase are subject to our Refunds and Returns Policy published on the website https://www.lizaclements.com.au/delivery-and-returns. We have endeavoured to accurately display colors and images of our products appearing in the store, however we cannot guarantee that the colours displayed on your computer monitor will be an accurate representation. All product dimensions listed are approximate, slight size variations may occur.
SECTION 4 - DELIVERY
Every effort is made to despatch goods within turnaround times stated on the website however on rare occassions this is not possible. https://www.lizaclements.com.au/delivery-and-returns. If you request for your parcel to be left in a safe place without a signature we take no responsibility for lost or damaged goods. International delivery is on application only. Availability of this service is at our own discretion. You will be responsible for any additional custom/import fees and taxes if applicable. If your parcel does not arrive due to incorrect address being supplied we can not be held responsible for any loss or additional charges.
SECTION 5 - INTELLECTUAL PROPERTY
The Service and and all materials therein or transferred thereby, including, without limitation, images, text, graphics, logos, copyrights, photographs, audio, videos, and all Intellectual Property Rights related thereto, are exclusively the property of Liza Clements Photographic. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publish, adapt, edit or create derivative works thereof.

You agree to indemnify and hold Liza Clements Photographic harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the products or services offered on the website.

To the maximum extent permitted by applicable law, in no event shall Liza Clements Photographic be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service and/ or products.
To the maximum extent permitted by applicable law, Liza Clements Photographic assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
SECTION 8 - OPTING IN, COMMUNITY PUBLIC PROFILE
If you opt in to join the community via our service all users of that online community have a public profile that is publicly visible to site visitors, and their public activity (such as their posts or comments) will be visible to other visitors of the website.
